CANE GARDEN BAY VILLAS & ASSOCIATES
TERMS & CONDITIONS:
After booking, your rental deposit must be received in our offices within 10 DAYS. Your payment constitutes your acceptance and agreement to the terms, conditions, limitations and restrictions described below. If you have questions, phone for discussion and explanation before sending your rental deposit.
PAYMENT AND CANCELLATION OF POLICIES:
Half of the rent is due in our offices within 10 days of booking to guarantee your reservation. Failure to make this payment will result in an automatic cancellation. The balance due of rent, Government Hotel Tax, and a separate damage deposit must be paid in full at least 15 days prior to your arrival. Cancellations and requests for changes to the reservations (such as date changes, villa or number of guests) must be made IN WRITING, and faxed, emailed or mailed to us promptly. Once we have received your half of the rent and confirmed your reservation, any changes made to your dates or villa will be charge a $50 dollar administration fee collected with your final payment. If you cancel more than 45 days prior to your arrival date, 80% of your total will be refunded and 20% retained by Cane Garden Bay Villas. If you cancel within 30 days of your arrival date, 100% of your total will be retained by Cane Garden Bay Villas.
No-shows, late arrival,s change in the number of guests in your group after arrival and early departures are all non-refundable. NO refunds are granted once guests have arrived to final destination unless there is a serious problem which cannot be remedied within 72 hours or which causes Guests extreme discomfort or serious threats to health or safety (also Complaints and Maintenance). Guests who abandon their villa without permission or notification to Cane Garden Bay Villas agree that they have no rights to compensation. ATM cards are accepted at certain banks and ATM machines. Please travel with American Express, Mastercard or Visa credit cards. There is also 7% Hotel Tax on Tortola, so be sure you figure this additional cost into your vacation budget!
DAMAGE DEPOSITS:
Damage deposits are refunded within 30 days of your departure, provided there is no breakage, damage, missing items, additional cleaning for the villas left excessively dirty, long-distance calls charged to the house telephone, and no other charges incurred before, during or after your stay. Normal utilities (except long-distance calls) are included in your rental. Water is at a premium, so use only what you need. Guests agree to pay Cane Garden Bay Villas for the cleaning or replacement costs for ALL damages to personal property or real estate, which may occur because of your occupancy, excluding normal wear and tear.
LIABILITY:
Cane Garden Bay Villas, acting as agents for accommodation, assumes neither liability for property loss or damage, nor liability for any injury, accidents, delay, or irregularity which may occur by reason of a defect in any vehicle or acts of any company or persons engaged in conveying passengers to or from their villa. Such companies or persons may include, but not limited to providers who operate independently of Cane Garden Bay Villas supply transportation (airlines, ferry, charter vessels, rental cars and taxis). CGBV assumes no responsibility for any loss, injury or damage to person or property losses caused by those providers. Guests are responsible for their villa during occupancy and must lock villa windows and doors securely at all times when leaving the premises. PETS:
No Pets (other than service dogs) are allowed in or on the villa’s premises without written permission from Cane Garden Bay Villas. A pet or evidence of a pet found on premises will cause immediate eviction and forfeiture of Guest’s entire rent and deposit.
COMPLAINTS AND MAINTENANCE:
Cane Garden Bay Villas will attempt to keep all villas and their inventories in good working order. In case of a maintenance problem, we will strive to repair the problem after being notified. However, no refund or adjustments will be made for unforeseen mechanical failures such as the supply of electricity, water, pool filtration systems, air conditioning, television or cable service, appliances, etc.
ILLEGAL SUBSTANCES AND HAZARDOUS MATERIALS:
Guests will not use or permit to be brought into any villa illegal substances or flammables such as gasoline, kerosene, naphtha, benzene, or explosives or articles deeded hazardous to life or limb. Guests arrested for possession or use of illegal substances may be immediately evicted and may forfeit their entire rent and deposit
VILLA KEYS:
Cane Garden Bay Villas will charge $50.00 for each set of lost or mishandled keys.
CAPACITY OF VILLA:
Total guests permitted in the villa at anytime are restricted to the number of guests who have scheduled and paid. Should a group be misrepresented, they must pay for the extra persons immediately or vacate the villa without a refund. Infants sleeping in a crib are not included in the total headcount.
JEEP/CAR RENTALS:
We recommend that you ask for additional local car/jeep insurance, as many USA Insurance agencies will not recognize or cover vehicles rented outside the USA. You may be held responsible for the complete loss or damage of the rental vehicle. Should you need rental car/jeep information, please call us – we will help with advice and recommendations.

RATES:
RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE. However, we will honor the correct rate in effect at the time your initial deposit is paid to us.
